Texas Pay Stub Requirements

Reviewed October 16, 2026. Educational guidance for employers and employees; special industries, local rules, and exemptions can change what applies.

Are pay stubs required in Texas? The answer depends on legal coverage: the Texas earnings-statement provision does not apply to FLSA-covered employees. Payroll recordkeeping duties still matter, and TWC recommends providing a check stub even when this state provision does not require one.

When a pay statement is required

The Texas Workforce Commission explains that the Texas Minimum Wage Act earnings-statement requirement does not apply to employees covered by the federal Fair Labor Standards Act because of the state Act’s exemption. Do not turn that distinction into a claim that Texas employers have no payroll recordkeeping duties.

What the statement must show

First determine whether the state earnings-statement provision applies. TWC recommends giving employees receipts or check stubs even where not required by that provision. For useful voluntary documentation, show the pay period, earnings calculation, itemized deductions, and payment total. These recommended fields are not presented here as a universal Texas statutory list.

Electronic delivery and access

TWC explains that earnings statements can be written or electronic and recommends protecting statements sent by email. Confirm the recipient and use an appropriate private delivery method; payroll information should not be sent to a shared public inbox.

Separate the statement from proof of payment

A well-formatted statement describes payroll, while a payment confirmation helps establish that funds moved. Keeping both makes it easier to investigate a missing deposit. A newly generated PDF cannot substitute for an employer’s actual payroll or bank record.

Practical payroll review example

For a fictional $1,000 gross payment with $150 in deductions, a statement can explain the $850 net amount. If the worker receives two deposits of $500 and $350, retain the split-payment record so the amounts can be reconciled without treating one deposit as the entire paycheck.

Before issuing or checking a statement

Use the following workflow alongside the state requirements, rather than treating a generic template as a compliance checklist.

  • Confirm federal and state coverage before declaring a statement optional.
  • Keep enough source records to explain hours, rates, and deductions.
  • Use a consistent pay-period label on the statement and payment record.
  • Resolve disputed entries with payroll rather than inventing replacement figures.
