A New York wage statement should let the worker connect a payment to the work it covers. A pay-rate notice at hiring and the statement supplied with wages serve different purposes.
When a pay statement is required
New York Department of Labor guidance under Labor Law section 195(3) requires a statement with each wage payment. A worker may also request a written explanation of the wage calculation.
What the statement must show
Include covered work dates; employee and employer names; employer address and telephone; pay rates and basis; gross wages; deductions; applicable minimum-wage allowances; and net wages. Nonexempt workers need regular and overtime rates and hours. Piece-rate workers need rates and quantities. Home-care benefits and prevailing-wage supplements have additional rules described in LS45.
Electronic delivery and access
The field guidance cited here establishes statement content, not a complete electronic-consent procedure. Before switching from paper, verify the current delivery requirements with NYSDOL. As a practical control, test employee access and a printable copy rather than assuming direct deposit supplies a wage statement.
Keep allowances separate from deductions
An allowance claimed toward minimum wage is not simply another withholding line. Payroll reviewers should ask what each line represents and retain the supporting calculation. Do not relabel a tip credit, benefit supplement, or deduction merely to fit a template.
Practical payroll review example
Suppose a statement reports 38 regular hours and 4 overtime hours but the time record shows 42 hours spread across two workweeks. The period total alone cannot explain overtime. Compare the weekly records and the applicable rules before deciding whether either document needs correction.
Before issuing or checking a statement
Use the following workflow alongside the state requirements, rather than treating a generic template as a compliance checklist.
- Identify the actual work dates rather than copying only the deposit date.
- Reconcile separate earnings lines to the payroll register.
- Keep the rate notice and any written explanation with the payroll file.
- Ask for clarification of unexplained allowance or supplement codes.

Prepare a paystub from verified payroll records
Use the PayStubPro generator to format accurate payroll information. Paystubs cost $1 each with a $2 minimum order: one or two cost $2 total, three cost $3, and ten cost $10. W-2 and 1099 forms are priced separately. A generated document does not establish that wages were paid or guarantee compliance or acceptance.
